These Terms of Service ("Terms") apply to your use of balebody.com (the "Site") and to any purchase you make from Bale ("Bale", "we", "us" or "our"). By using the Site or placing an order, you agree to these Terms. If you do not agree, please do not use the Site.

1. Use of the site

You may use the Site for lawful, personal, non-commercial purposes. You agree not to misuse the Site, interfere with how it works, access it by automated means without our permission, or use it to break any law. You must be at least the age of majority where you live, or use the Site with the involvement of a parent or guardian. If you create an account, you are responsible for keeping your login details secure and for activity under your account.

2. Products and pricing

We describe and photograph our products as accurately as we can, but small differences can occur. Every order is wrapped by hand in a piece of a real coffee sack, so no two wraps look the same. Prices are shown in US dollars and may change at any time before you place an order. If a product is listed at a wrong price because of an error, we may cancel orders for that product and refund you in full. Scent descriptions such as "inspired by" refer to the general scent profile. Bale is not affiliated with or endorsed by the fragrance houses named on the Site, and their names and trademarks belong to their owners.

3. Orders and payment

When you place an order, you offer to buy the products in your cart. We may accept or decline an order, for example when a product is unavailable, when there is a price or description error, or when we suspect fraud. If we cancel an order after you have paid, we refund you in full. Payment is taken at checkout through Shopify's checkout and its payment providers. You confirm that you are allowed to use the payment method you provide. Subscription is optional and off unless you choose it. If you choose it, you can manage or cancel it from your account.

4. Shipping and returns

We ship to US addresses only. Shipping times, costs and tracking are covered in our Shipping Policy. Our 30-day money-back guarantee, free scent swap and replacement of damaged or wrong items are covered in our Refund Policy. Both policies form part of these Terms.

5. Using our products

Bale products are cosmetics for external use only. Before first use, do a patch test: put a small amount on your inner arm and wait to see how your skin reacts. If irritation, redness or discomfort happens, stop using the product and wash the area. Do not apply to broken or irritated skin, keep the product away from your eyes, and keep it out of reach of children. If you have a skin condition or allergies, ask your doctor before use. Our products are not intended to diagnose, treat, cure or prevent any disease.

6. Intellectual property

The Site and its content, including the Bale name and logo, text, images, videos and design, belong to Bale or its licensors and are protected by intellectual property laws. You may not copy, reproduce, distribute or use them for commercial purposes without our written permission.

7. Disclaimers

The Site and our products are provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement, except those stated in these Terms and in our Refund Policy. How long a scent lasts and how a product feels varies from person to person, and we do not promise any particular result.

8. Limitation of liability

To the fullest extent the law allows, Bale and its owners, staff and suppliers are not liable for any indirect, incidental, special, consequential or punitive damages arising from your use of the Site or our products. Our total liability for any claim relating to a product or an order is limited to the amount you paid for that order. Some states do not allow certain limitations, so some of these may not apply to you.

9. Governing law

These Terms are governed by the laws of the State of Georgia, without regard to its conflict of law rules. Any dispute relating to these Terms, the Site or your order will be handled in the state or federal courts located in Fulton County, Georgia, unless the law where you live requires otherwise.

10. Changes to these Terms

We may update these Terms from time to time. The updated version takes effect when it is posted on this page with a new "Last updated" date. Orders already placed are governed by the Terms in effect when you placed them.
